General Terms and Conditions

1. general

1.1 These General Terms and Conditions (GTC) govern the contractual relationship between the participants of BarFlirt events and the platform BarFlirt.ch, operated by BarFlirt GmbH.

1.2 By purchasing a ticket for a BarFlirt event, participants accept these GTC in full.

2. age restriction 18+

2.1 Persons under the age of 18 are prohibited from placing orders on the Website. BarFlirt GmbH reserves the right to refuse to execute an order or to cancel it if irregularities or misuse of our order function are suspected.

2.2 The participation age for events is currently (as of 01.07.24) 25 years. The exact age group is specified for each event when the order is placed and must be adhered to.

3. participation requirements

3.1 Only persons of legal age (minimum age 18) are eligible to participate.

3.2 Participants must provide honest and accurate personal information. Incorrect information may lead to exclusion from the event.

4th BarFlirt events

4.1 BarFlirt events are events that are organized by BarFlirt GmbH, hereinafter referred to as the "Organizer". These GTC govern the relationship between the event participants, hereinafter referred to as "Participants", and the Organizer.

4.2 By participating in events, you consent to the possible use by BarFlirt of the image and sound material created by you at the events for internal and external marketing purposes. Any use is not restricted in terms of time and geography.

5. conditions of participation

5.1 The contract between a participant and the organizer is only concluded when all registration details have been provided, the invoice amount has been received and the completeness of the registration has been confirmed by the organizer.

6. subject matter of the contract

6.1 The Organizer shall provide the following services:

• Planning the events, checking and reserving locations and drawing up a schedule for the teams to meet at one or more locations on different days of the week and at different times, depending on the type of event chosen.
• The provision of an online platform with information on the booked events and their schedule.
• Providing an online platform where participants can find the respective schedule, FAQs and a live support function in case of questions or if participants need support.
• The provision of a secure individual online profile for all participants, which lists all past and future events that have been booked or attended.
• The provision of a matching-as-a-service platform, which participants can use from home after the events to choose who they liked / liked and through which contact details are automatically exchanged (via e-mail) if there is mutual interest.
• Information via e-mail about all steps from booking to matching.

7 Cancellation provisions by the participants

7.1 It is not possible to receive a refund if a participant is unable to attend. This is due to the fact that this can result in a large number of last-minute cancellations, which entails a great deal of administrative work for the organizer (reorganizing groups, rescheduling, finding replacements). If one participant is properly cancels (mandatory via message to the support number in the profile) up to 60 hours before the start of the event, receives the participant a voucher from the organizer in the amount of 50% of the amount paid.

8 Cancellation provisions by the organizer

8.1 It may happen that the BarFlirt event has to be canceled by the organizer if not enough people have registered. This will happen at least 15 hours before the event. In this case, all participants will receive their money back or a voucher for an alternative event of their choice (valid for 2 years).

8.2 Events may be canceled due to force majeure (e.g. storm, earthquake, flooding, pandemic, power shortage, etc.). In this case, you will receive a voucher for a replacement event of your choice (valid for 2 years).

9 Obligations of the participants

9.1 The participants undertake to treat each other with respect and courtesy.

9.2 Harassment, discrimination or other inappropriate behavior will result in immediate exclusion from the event and from future events.
9.3 All information must be recorded truthfully.

10. insurance / exclusion of liability

10.1 The organizer hereby rejects any liability and leaves the insurance obligation to the individual participants. Participation is at the participant's own risk.

10.2 The operator is not liable for the success of the contact mediation.

11. exclusion of participants

11.1 The organizer reserves the right to exclude participants from events without giving reasons. In this case, any ticket costs will be refunded.

12. data protection

12.1 Participants' personal data will be treated confidentially and used only in the context of the events and the matching platform.

12.2 Data will not be passed on to third parties without the express consent of the data subject.

13. deletion of the user account

13.1 The user account can be deleted by the participants at any time. This is done by deleting the user account on the platform.

13.2 If the user account is deleted, all current or future booked events will be forfeited.

14 Intellectual property

14.1 All content on the BarFlirt Platform, including text, graphics, logos, images, software and algorithms, is the property of BarFlirt GmbH and protected by Swiss copyright law.

14.2 The use of this content without the express written permission of the operator is prohibited.

15. amendment of the GTC

15.1 The Organizer reserves the right to amend these GTC at any time.

15.2 Participants will be notified of any changes in good time on the BarFlirt.ch website.

16 Applicable law and place of jurisdiction

16.1 Swiss law shall apply exclusively.

16.2 The place of jurisdiction is the registered office of the Operator.

17. severability clause

17.1 Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
